1. About These Terms
These Terms of Service (“Terms”) govern your use of www.atelierco.store (the “Site”) and the purchase of products from Atelier & Co (“we”, “us”, “our”).
By accessing our Site or placing an order, you agree to be bound by these Terms together with our Privacy Policy, Refund Policy and Shipping Policy (the “Policies”), which are incorporated by reference and form part of this agreement.
Nothing in these Terms limits or excludes your rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

3. Placing an Order & Contract Formation
When you place an order, you are making an offer to purchase.
A legally binding contract is formed only when we send you an Order Confirmation email confirming acceptance of your order.
We reserve the right to decline or cancel an order before dispatch where necessary, including for product unavailability, pricing or listing errors, payment authorisation failure, or suspected fraudulent activity.
If an order is cancelled prior to dispatch, a full refund will be issued.
4. Product Information
We take care to ensure product descriptions, images and ingredient information are accurate. However, colours may vary slightly due to screen settings; packaging updates may occur; and ingredient lists may change to reflect regulatory updates.
All products must meet the standards required under the Consumer Rights Act 2015: they must be as described, of satisfactory quality and fit for purpose. If they are not, you are entitled to remedies under UK law.
5. Pricing & Payment
All prices are shown in GBP (£). VAT is included where applicable. Delivery charges are shown separately at checkout. Payment is required in full at the time of order.
We reserve the right to correct obvious pricing errors. If such an error is identified before dispatch, we will contact you before proceeding.
6. Delivery
Delivery times are estimates and not guaranteed.
Risk in the goods passes to you upon delivery to the address provided. Ownership transfers once full payment has been received.

7. Your Right to Cancel (Distance Selling Regulations)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods, without giving a reason.
To exercise this right, you must notify us within 14 days of delivery. You then have a further 14 days to return the goods.
Refunds will be processed in accordance with our Refund Policy.
Exceptions
The right to cancel does not apply to:
- Sealed goods which are not suitable for return due to health protection or hygiene reasons, where the seal has been broken after delivery; or
- Personalised or bespoke products.
For hygiene reasons, cosmetic and skincare products that have been unsealed or used after delivery are not eligible for cancellation under the Consumer Contracts Regulations 2013.
This does not affect your statutory rights if goods are faulty, damaged or misdescribed.
8. Faulty or Misdescribed Goods
If goods are faulty, not as described, or not of satisfactory quality, you are entitled to remedies under the Consumer Rights Act 2015. Nothing in these Terms excludes or limits those rights.
9. Refunds
Refund procedures, timelines and conditions are set out in our Refund Policy, which forms part of these Terms. Refunds are issued via the original payment method unless otherwise agreed.
10. Intellectual Property
All content on this Site — including branding, product names, imagery, text and design — is owned by Atelier & Co or licensed to us. You may not reproduce, copy, distribute or commercially use any content without prior written consent.
11. Acceptable Use
You agree not to use the Site unlawfully, attempt to disrupt or interfere with Site functionality, introduce malicious software, or extract data through automated means. We reserve the right to restrict access where misuse is detected.
12. Product Use & Safety
Our products are cosmetic in nature and are not intended to diagnose, treat or cure medical conditions. We recommend patch testing before use. If you have allergies or medical concerns, consult a qualified professional prior to use. This clause does not affect your statutory rights regarding faulty goods.
13. Limitation of Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any matter which cannot legally be excluded under UK law.
Subject to the above, we are not liable for indirect or consequential losses. Our total liability in relation to any order is limited to the purchase price of that order.
14. Force Majeure
We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, supply chain disruption or government action.
15. Third-Party Services
We use third-party providers for payments, website hosting and related services. We are not responsible for third-party systems or their independent terms.
16. Changes to These Terms
We may update these Terms from time to time. The version in force at the time of your order will apply to your purchase.
17. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction of the courts of England and Wales.
